In an accident involving a serious injury, it is essential to secure an early admission of liability in order to obtain the crucial treatment needed to aid a client’s recovery.

For injuries which are life changing, often it is necessary to instruct a case manager who can assist in obtaining the treatment and rehabilitation urgently needed. This early intervention can drastically improve the client’s outlook physically and mentally.

What is case management?

Case management is a service provided by an experienced professional to manage a person’s rehabilitation and care following an injury which has reduced their independence. The professional is usually a qualified therapist such as a nurse, physiotherapist or occupational therapist.

The insurer for the party who caused the accident will usually pay for this service but will not usually agree to do so unless they accept liability for the accident.

Once appointed by your Solicitor, the case manager will assess the client’s rehabilitation needs and address what is needed to rehabilitate them to aid their recovery. The solicitor will make sure that the client is happy with all of the recommendations made and will support them if there are any issues. The case manager can liaise with the treating doctors and make a case to the insurer for payment for private treatment or therapy. Again, the Solicitor can assist with any issues which may occur if the insurer disputes what is being suggested/requested.

The case manager can also assess what care and domestic assistance may be needed. They can help with accommodation, adaptations, aids and equipment needs. They can also assist with employment issues, obtaining advice about state benefits and applications.

For clients who have suffered life changing injuries, a case manager can support and help them and their family come to terms with what has happened to them. Case management can assist clients regain their independent and improve their quality of life following a serious accident that was not their fault.

Interim Payments

Often a serious injury may mean that a client cannot return to work afterwards or at all. This will very shortly bring about financial stresses and worry. If the insurance company for the person at fault accepts liability, they may be willing to make an interim payment to the injured party. An interim payment is an advance of damages. For very serious injuries, your solicitor will be mindful of the potential value of the claim and will be able to make a request for an interim payment to help a client gain access to funds before the end of the claim. This can help with financial pressures and allow clients to focus on their recovery.
