We have successfully concluded a medical negligence claim for one of our clients.  This client has agreed that we can use her file as a case study for marketing purposes.

The facts were as follows:-

The Claimant alleged that she had asked for a caesarean section on a number of occasions as she was not making progress. The Defendant disputed this. We successfully secured medical evidence to confirm that she should have been offered a caesarean section sooner than she was. However, there was a factual dispute with the Claimant’s version of events and the records.

As the Claimant was not offered a caesarean section sooner, the baby’s head became impacted, and she then had to have an emergency caesarean section which was more complicated. This resulted in more extensive surgery, and she suffered a tear to the broad ligament. This was noted but not stitched and subsequently she developed further problems after the birth including ongoing undetected bleeding.

She had to have further surgery and was unable to bond with the baby initially due to intense pain and discomfort.

There was one Defendant pursued.

Court proceedings were issued however the parties entered into settlement discussions which resolved successfully in the Claimant’s favour.

The matter was due to go to a final Trial however it was settled prior to the same.
