In April 2021, we reported that the Road Traffic Accident (RTA) claims process was changing. The majority of whiplash type injuries arising out of a no fault RTA will now be dealt with via the Official Injury Claim’s portal. A guide has recently been published which we will be giving out to clients who may be affected by these changes, but more helpfully, information about why the changes have come about has now been published.

Just to summarise, the changes include a tariff system for damages, which are less favourable than the level of damages currently in place. See table below which sets out the likely damages which can be recovered for whiplash type injures up to £5,000. Column 1 sets out the damages for the physical injury and column 2 shows the damages where there is minor psychological injury as well.
